Liability Release: (A)In signing this application, we understand and will
abide by the rules set for this tournament and are enclosing an entry fee.
We hereby waive and release Indian River County Sheriffs Office, the hosts,
sponsors, agents, and all other contestants (hereafter referred to as IRCSO),
"ET AL") from any and all claims of injury and/or material and bodily damage
in connection with the tournament. ( B) Covenant not to sue and waiver of
subrogation: We further agree that we will never sue IRCSO , et al, for
damages on account of any injury we suffer or cause whether known now or
which may develop in the future. We expressly agree to indemnify and hold
harmless IRCSO, et al from any liability whatsoever. We understand that in
waiving our rights to sue IRCSO, et al, we also are waiving the rights of
recovery from IRCSO, et al, of my insurance carrier for any claims that may
pay in our behalf. Any and all litigations will be held in the in the county
of residence of IRCSO, et al. (C) We further state that we maintain
liability insurance on the boat we will use in this tournament. (D) We agree
to submit to a polygraph test, if requested by the tournament officials, and
that said polygraph examiners decision will be accepted by us without further
appeal. Failure of such polygraph will automatically disqualify us from the
tournament (E) We agree that IRCSO, et al, and their agents may photograph
and or videotape us, in connection with this tournament and may use said
photographs/videotape, and our name in any commercial use without our
written consent.
